Terms & Conditions

1. Definitions

  • "Nestpoint" means Nestpoint, a sole proprietorship registered in Sarawak, Malaysia, and referred to throughout as "we", "us" or "our".
  • "Services" means the educational sessions, evening courses, enterprise consulting engagements and related materials offered by Nestpoint.
  • "User" / "you" means any person who accesses this website or registers for a Nestpoint programme.
  • "Agreement" means these Terms and Conditions, together with the Privacy Policy and any specific engagement letter or booking confirmation.
  • "Content" means all written materials, workbooks, templates and documents produced by Nestpoint in connection with a Service.

2. Acceptance of Terms

By using this website or registering for a Nestpoint programme, you confirm that:

  1. You are aged 18 years or over, or are an authorised representative of a Malaysian organisation;
  2. You have read and understood these Terms and Conditions and agree to be bound by them;
  3. You have the legal capacity to enter into this Agreement under Malaysian law.

If you do not agree, please do not use this website or register for any programme.


3. Service Description

Nestpoint provides education, information organisation and operational consulting services relating to retirement documentation and pension paperwork. All services are general in nature. Nothing provided by Nestpoint constitutes personalised financial advice, legal advice, pension entitlement calculations, or any other regulated activity under Malaysian law. Sessions comment only on file organisation and completeness, not on the substance, meaning or financial implications of any document.

Services are available to individuals and organisations located in Malaysia. Nestpoint reserves the right to decline a booking at its discretion.


4. User Responsibilities

  • You must provide accurate contact information when submitting an enquiry or registration.
  • You must attend booked clinic slots at the confirmed time. Missed slots without 48 hours' notice forfeit the session fee.
  • You must not use Nestpoint's materials for any unlawful purpose or in a manner that infringes the rights of others.
  • You must not record sessions without prior written consent from Nestpoint.
  • You must treat facilitators and other participants with respect throughout all sessions.

5. Intellectual Property

All Content produced by Nestpoint — including workbooks, templates, gap records, flow maps and bilingual terminology materials — remains the intellectual property of Nestpoint. A limited, non-exclusive, non-transferable licence is granted to the individual or organisation for whom the Content was produced, for their own internal use only. You may not reproduce, sell, distribute or adapt Nestpoint materials without prior written permission.


6. Fees and Payment

All fees are stated in Malaysian Ringgit (RM) and are inclusive of any applicable taxes unless stated otherwise. Current fees:

  • Annual Records Review Clinic: RM 530 per appointment
  • Retirement Transition Documentation Course: RM 2,050 per participant
  • Enterprise Documentation & Handover Consulting: RM 4,720 per engagement

Payment is due in full prior to the commencement of the session or course unless otherwise agreed in writing for enterprise engagements. Accepted payment methods will be confirmed at booking.

Refund policy: Clinic and course fees are non-refundable after 48 hours prior to the session. Where Nestpoint cancels a session, a full refund or rescheduled slot will be offered. Enterprise engagement fees are subject to the terms of the signed engagement letter.


7. Programme-Specific Terms

Annual Records Clinic: Slots are 20 minutes by appointment. Participants must bring their own documents. Nestpoint does not retain documents after the session. The written gap record produced is based on observation only.

Evening Course: Attendance at all eight sessions is encouraged but not mandatory. Course materials are provided for the personal use of the registered participant only. No certificate of completion is issued; this is a non-accredited educational programme. Guest sessions are provided by independent practitioners acting in their own capacity; Nestpoint is not responsible for the content of guest contributions.

Enterprise Consulting: Scope is governed by the signed engagement letter. Advisory scope is strictly operational and communicative. Interpretation of scheme terms, legal rights or financial entitlements remains with the client's own qualified professionals at all times.


8. Disclaimers

Services are provided in good faith on an educational and operational basis. Nestpoint makes no representation that its services will result in any particular outcome for participants. All information provided in sessions is general in nature and does not constitute personalised advice of any kind. Participants and clients are encouraged to consult appropriately qualified practitioners — including licensed financial planners, EPF-registered advisers and legal practitioners — for matters requiring regulated professional input.

This website and its content are provided without warranties of any kind, express or implied.


9. Limitation of Liability

To the extent permitted by Malaysian law, Nestpoint's total liability to any individual user or client in respect of any claim arising from or in connection with our services shall not exceed the fee paid by that user or client for the specific programme giving rise to the claim. Nestpoint shall not be liable for indirect, consequential or economic losses of any kind.


10. Indemnification

You agree to indemnify Nestpoint against any claims, losses, damages and expenses (including reasonable legal costs) arising from your breach of these Terms or your misuse of any materials or information provided in our sessions.


11. Termination

Nestpoint reserves the right to refuse or terminate access to any programme where a participant acts in a manner inconsistent with these Terms or the safe and respectful conduct of sessions. Where a session is terminated early by Nestpoint due to participant conduct, the session fee is non-refundable. Either party may terminate an enterprise engagement in writing with 14 days' notice; fees for work completed to that date remain payable.


12. Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising under or in connection with this Agreement shall first be subject to good faith negotiation between the parties. Where a dispute cannot be resolved by negotiation within 30 days, either party may refer the matter to mediation under the Malaysian Mediation Act 2012. The courts of Malaysia shall have exclusive jurisdiction over any dispute that proceeds to litigation.


13. General Provisions

  • Entire agreement: These Terms, together with any engagement letter and the Privacy Policy, constitute the entire agreement between the parties.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: You may not assign your rights or obligations under these Terms without Nestpoint's prior written consent.

14. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this page will reflect any revision. Continued use of our website or services after an update constitutes acceptance of the revised Terms.
